- The auction is organized by BWFA vzw, with its registered office at Oudeveldstraat 180, 9080 Lochristi.
- Participation in this auction implies the explicit and unconditional acknowledgment and acceptance of these auction terms and conditions.
- The seller shall pay an entry fee of 250 EUR + VAT to BWFA.
- The minimum price (reserve) at which the foal can be considered sold must be specified during the selection process.
- The seller is liable for 15% auction commission on the hammer price (excluding VAT).
In the event of buy-back of the horse by the seller, the following rates apply:- < = 10,000 EUR: 5% auction commission
- > 10,000 EUR: 10% auction commission
- If no minimum price was specified during selection, a 10% auction commission will be charged upon buy-back, regardless of the hammer price.
- A selected horse must participate in the auction; failure to do so will legally entitle the organization to compensation from the seller in the amount of 4,000 EUR.
- If a horse cannot participate for health reasons, this must be reported to BWFA immediately in writing, including a description of the condition. A veterinarian will then determine the nature of the condition, and the veterinarian's findings are binding.
- Delivery takes place at the risk and expense of the seller, provided the place of delivery is within Belgium.
- The auction organization is not responsible for preparing, following up, or issuing documents required if a VAT-registered foal is sold to a non-Belgian buyer. The Belgian seller must prove to the administration that the horse has left Belgium.
- Sellers are required to present their horses in good auction condition for the photo session and at the auction location. Foals presented in poor condition may be refused entry. The auction committee undertakes to communicate such decisions in a timely manner via email.
- The seller cannot derive any rights from the fact that the auction organization selected the horses or, if applicable, subjected them to a veterinary examination.
- BWFA will pay the amount due to the seller only after all payment obligations toward BWFA have been met by both the seller and the buyer, and after receiving written confirmation of the correct delivery of the horse.
- The BWP / Zangersheide / SBS studbook papers must be delivered to BWFA. If the studbook document is not provided upon delivery of the horse, a deposit of 400 EUR will be withheld by BWFA. BWFA will refund the deposit upon receipt of the papers.
- BWFA is not liable for any damage prior to, during, or after the auction to persons, goods, or horses.
- As the auction organizer, BWFA never becomes a party to the sales contract between the buyer and the seller; it acts solely as an intermediary. No rights can be derived from this role, nor can BWFA be held liable in any capacity.
- The auction is supervised by a notary or bailiff, assisted by auctioneer Dirk Zagers.
If a dispute arises regarding who made the final bid, or if other ambiguities occur during bidding, the auctioneer is authorized to issue a binding judgment. - In case of dispute, only the Dutch text of the general terms and conditions prevails. In the event of a legal dispute, the courts of the judicial district of Ghent (Ghent division) shall have exclusive jurisdiction. Any dispute arising from this auction and its consequences is governed exclusively by Belgian law, excluding the provisions of the Vienna Sales Convention on international sales.
